Terms of Service

These Terms and our Acceptable Use Policy govern your use of Featurelab. Our Privacy Policy explains how we handle personal information. By creating an account you accept these Terms.
1. Who we are
Featurelab is operated by Kyle Grattan, a sole trader trading as Featurelab, based in New Zealand. You can reach us at support@featurelab.video.
In these Terms, Featurelab Materials means the service, software, templates, themes, components, scene systems, documentation and other materials we provide, excluding your content. Your content means everything you upload, write or configure.
2. Your account
You need an account to use the service. You must be at least 16, provide accurate information, and keep your login secure. You are responsible for activity under your account.
Where an account is created or managed for an organisation, the organisation is the customer and controls the projects and content in that account. Individual authorised users may use it on the organisation’s behalf. If you accept these Terms for an organisation, you confirm you have authority to do so.
Organisation administrators may manage users, access projects in that account, remove content, control integrations, and export or delete organisation data. You are responsible for ensuring your administrators and authorised users have appropriate permissions.
3. Who owns what
Your content stays yours.
You keep all rights in what you upload — screenshots, recordings, audio, copy. As between you and Featurelab, and to the extent permitted by law, you own the videos generated from your content and instructions. We assign to you any rights we may have in those outputs, excluding Featurelab Materials, third-party materials and the underlying software.
You grant us a limited licence to host, process, transmit and display your content strictly to operate the service for you. That licence ends when the content is permanently deleted from our active systems, except that it continues for the limited period needed to complete deletion from backups, comply with the law, resolve disputes and enforce these Terms.
Featurelab Materials stay ours.
We grant you a worldwide, perpetual licence to use Featurelab Materials incorporated into videos you lawfully generate, including commercially. That licence survives cancellation, so videos you have already exported remain yours to use. It does not permit you to extract, redistribute or sell the templates, themes or software separately.
If you send us feedback or suggestions, you grant us a worldwide, perpetual, royalty-free licence to use them without restriction or compensation. This gives us no rights in your content or confidential information.
Copyright in AI-generated material is unsettled in several countries. We do not warrant that AI-generated output is protectable, nor that it is free of third-party rights.
4. Acceptable use
Your use must comply with our Acceptable Use Policy, which forms part of these Terms. It covers voice rights and impersonation, prohibited content, and misuse of the platform. Breaching it may lead to suspension or termination.
5. Confidentiality
We treat non-public content you provide as confidential, and use it only to operate, secure and support the service, except where you authorise disclosure or the law requires it. This matters for unreleased product screenshots, roadmaps, investor material and launch assets.
This does not apply to information that is or becomes public through no fault of ours, that we already held or developed independently, or that we lawfully received from someone else without a duty of confidence.
6. Fair-use limits and service changes
Limits apply to rendering, AI assistance and narration to keep costs predictable and prevent abuse. Current limits, and how they reset, are shown in the app. Limits may change, and we will give notice before reducing one materially. A change will not reduce paid usage already purchased for the current billing period unless reasonably necessary for security, legal compliance or preventing material abuse.
Where reasonably practicable we will give advance notice before materially discontinuing a core feature. We may make immediate changes where needed for security, legal compliance, third-party availability or service integrity.
7. Beta and experimental features
Features labelled beta, preview or experimental may be incomplete, change substantially or be withdrawn. They may carry additional limits, and should not be relied on for critical production work unless we say otherwise.
8. Third-party services
Featurelab integrates with third-party services, including sign-in, AI and hosting providers. Your use of those services may also be governed by their own terms. We are not responsible for third-party services we do not control, although this does not limit the responsibilities the law places on us for our own choice of suppliers or our handling of your information.
9. Availability, accuracy and warranties
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, and equivalent consumer protections elsewhere.
Subject to that, and to the maximum extent permitted by law, we do not warrant that the service will be uninterrupted, error-free or fit for a particular purpose. The service depends on third-party providers, and maintenance or incidents will sometimes interrupt it.
AI-assisted scripts, summaries, captions, translations and generated media may contain errors or fabricated material. You must review factual claims, permissions, disclosures and suitability before publishing anything.
10. Your responsibilities
You are responsible for holding the rights to everything you upload, obtaining any permission needed for voices or likenesses, and for how you use what you create. You must comply with the laws that apply where you and your audience are, including any obligation to disclose AI-generated media.
11. Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Your rights as a consumer are unaffected.
Subject to that, we are not liable for indirect or consequential loss, lost profits or lost revenue. We are not liable for loss or corruption of data except to the extent it results from our failure to use reasonable care and skill, or where that liability cannot lawfully be excluded — so please keep your own copies of anything important.
Our total liability in any 12-month period is limited to the greater of NZ$100 and the amount you paid us in that period.
12. Indemnity (business users)
If you use Featurelab for business purposes, you will indemnify us against third-party claims, losses and reasonable legal costs arising from your content, your infringement of third-party rights, or your material breach of the Acceptable Use Policy. This section does not apply if you use Featurelab as a consumer.
If we seek indemnity we will notify you promptly, give you reasonable control of the defence, and will not settle in a way that admits fault by you or imposes a non-monetary obligation on you without your consent.
13. Ending the agreement
You can stop using Featurelab and delete your account at any time from your account settings. Deleting your account deactivates it immediately and schedules it for permanent deletion after a 30-day recovery period, during which you can ask us to restore it. Deletion is subject to the limited backup, security and legal-retention exceptions described in our Privacy Policy. Cancelling a paid plan is a separate action from deleting your account.
We may suspend or terminate your account if you materially breach these Terms or the Acceptable Use Policy, if your use poses a risk to other users or to the service, for non-payment once paid plans exist, or where we must to comply with the law. Except for severe breaches — where we act immediately — we will tell you what is wrong and give you a chance to fix it.
After termination your access ends. Unless immediate deletion is required for safety or by law, you will have 30 days to export your content before permanent deletion begins. You can export your projects and their configuration from your account settings at any time; for a copy of the personal information we hold about you, make a request under our Privacy Policy.
14. Payment
Featurelab does not currently charge for use. Before any charge is made we will publish the applicable payment terms — pricing, GST, billing cycle, renewal, cancellation, refunds, and the statutory cancellation rights that apply to consumers — and present them to you for acceptance at checkout.
15. Changes to these Terms
We may update these Terms. If a change is material we will notify you before it takes effect. If you do not agree to it, you may stop using the service and cancel before it applies. Changes will not apply retrospectively unless the law requires it or you expressly agree.
16. Notices
We may send notices to the email address on your account or display them in the service, so please keep that address current. Formal legal notices to us must be sent to legal@featurelab.video and to our business address above.
17. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over disputes. If you are a consumer, this does not deprive you of mandatory protections, or of any right to bring proceedings, available under the laws of the country where you ordinarily live.
18. General
If any part of these Terms is unenforceable, the rest continues to apply. If we do not enforce a right immediately, we do not give it up. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor of our business. Neither of us is liable for failure to perform caused by events beyond our reasonable control. These Terms, the Acceptable Use Policy and any payment terms are the entire agreement between us about the service.
